What to Expect at a Parole Board Hearing

When a person is sentenced to a term of imprisonment in Indiana, they may be eligible for release on parole under Indiana law. According to IC 11-13-3-2, the rules for parole and discharge eligibility depend on whether a person was sentenced following a conviction for a felony offense or misdemeanor, and if a felony, whether the person was sentenced for a charge of murder as opposed to another type of felony offense. These factors typically determine when a person can be eligible for parole.

For nearly all types of convictions, once a person becomes eligible for parole, they will be automatically paroled.  When an offender is accused of a parole violation, there would be a Parole Violation Hearing.

Parole Violation Hearing 

When a violation of parole has been alleged, the offender has the right to a public hearing, with the right to be represented by an attorney at that hearing.  At a Parole Violation Hearing the offender can testify, call witnesses, and present evidence.

Parole Review Hearing 

 If an offender is found in violation of their parole, they will be ordered to serve the remaining balance of their sentence and will remain in the custody of the Indiana Department of Correction until their Parole Review Hearing.  The Parole Review hearings are public hearings with the right to counsel.  However, only the offender may testify and only document evidence may be submitted on their behalf.  Parole Review Hearings will be held annually until the person is re-paroled or they have served out their sentence.
