What to Know About Lifetime Driver’s License Suspensions in Indiana

_CriminalLaw

For most people, losing their driver’s license even to a temporary suspension can have serious consequences on their life. It can make it difficult to get to work, drive your kids to school, and even run simple errands such as buying groceries. However, when a person’s driver’s license is revoked throughout their lifetime, it can make things even more difficult. Below, our Indianapolis license rehabilitation lawyer explains when a lifetime revocation may apply and how to get your driving privileges back.

HTV Category

People who have their driver’s license revoked for the rest of their lifetime are classified as habitual traffic violators (HTVs) in the state. There are three categories of HTVs and the first is Category A. This category is reserved for individuals who have received two judgments based on serious criminal offenses that caused injury or death during a ten-year timeframe. Some of the violations that can constitute a serious offense are as follows:

  • An accident resulting in death or injury and the motorist did not stop at the scene to provide assistance
  • Reckless homicide caused by driving a vehicle
  • Voluntary or involuntary manslaughter resulting from a motorist operating a vehicle
  • Intoxicated driving resulting in death

Motorists who have two judgments for the above serious offenses, or others, within a ten-year timeframe will lose their license for ten years. If the offenses involve alcohol leading to a person’s death, they will lose their license for the rest of their life.

HTV Category B

Motorists who accumulate three judgments for major offenses in a ten-year period will fall into HTV Category B. Some of the offenses that can qualify a person for this category include:

  • Reckless driving that results in felony charges
  • Driving with a blood alcohol concentration (BAC) level of 0.08 percent
  • Resisting a police officer
  • Speed contests or drag racing
  • Fleeing the scene of a crash
  • Driving a motorcycle in violation of the law
  • Any felony offense where operating a vehicle is involved
  • Any crime outlined in HTV Category A

Drivers who fall into this category will lose their driver’s license for ten years.

HTV Category C

Motorists who receive ten or more judgments in a ten-year period, including one serious offense outlined in Category A or B will fall into Category C. A person may also fall into Category C if they commit two other offenses, which are as follows:

  • Driving with a licensed that has been revoked or suspended
  • Driving when the person has never obtained a driver’s license

Motorists who fall into this category will typically lose their license for five years.
