Is It Possible to Appeal a Lifetime License Suspension? 

It is possible to appeal your lifetime license suspension. Although the process is not known as an “appeal,” the key takeaway is that you may be able to have your driving privileges reinstated even if you were subject to a lifetime license suspension or forfeiture when these still happened (prior to 2014).

What does the process involve for getting your driver’s license back? You will not be filing an “appeal,” but instead a legal petition to have the lifetime license suspension rescinded.

Filing a Petition for Rescission of Lifetime Suspension of Driving Privileges 

If you were subject to a lifetime license suspension, the first step in getting your license back is to file a petition for rescission of lifetime suspension of driving privileges under IC 9-30-10-14.1.

Under the statute, you are not eligible if you were classified as a habitual offender due to the reckless or intoxicated operation of a vehicle that resulted in another person’s death under IC 9-30-10-4(a). Others, however, may be able to file this petition as long as 10 years elapsed since the lifetime suspension — this should now be true for all potential applicants — and other conditions are met. In order to be eligible to file this petition, you will need to include specific statutory information in the petition.
